Discrimination

State and federal employment laws require employers to treat employees equally in hiring, termination, promotion, discipline and all other aspects of employment, without regard to the employee's status as a member of a protected class. Employees who are discriminated against or harassed based on their protected class status, may be entitled to recover damages for lost wages, emotional distress and other losses. Harassment

Sexual harassment and other types of harassment are unfortunately very common in the workplace, despite employers' efforts to educate employees. I represent the rights of individuals that have experienced or are currently experiencing ongoing sexual harassment or other workplace harassment, including:

  • Inappropriate hugging, kissing or other offensive physical contact of a sexual nature
  • Unwelcome sexually offensive posters, photographs, drawings, cartoons, jokes, stories or nicknames
  • Inappropriate comments about appearance
  • Ridicule for a mannerism, sexual preference or physical characteristics

Retaliation

Any adverse action taken by an employer against an employee for otherwise permissible conduct is considered retaliation. Retaliation is illegal across the United States and should not be tolerated by any employee. I represent clients that have been wrongfully terminated, demoted or punished for exercising their legal rights. This can include retaliation due to a report of discrimination or sexual harassment, a request for disability or leave under FMLA (Family and Medical Leave Act) and whistleblowing.
